Demy-Colton CEO Summit Europe Privacy Notice

This Privacy Notice describes how Demy-Colton Life Science Advisors, Inc. (referred to in this Privacy Notice as “Demy-Colton,” “we,” “us,” or “our”), as the operator of the website www.biotechceosummit-eu.com (the “Site”) collects information when you access, visit or use the Site. It also explains how we use and disclose the information we collect from you, and your rights in relation to that information. By accessing or using the Site, you expressly consent to our collection, storage, use and disclosure of your information as described in this Privacy Notice. Please note that if you disagree with anything in this Privacy Notice, you must not use the Site.

  1. Information Collected from You.
    1. Information You Directly and Voluntarily Provide to Us.The Site is intended to provide information about the Demy-Colton Biotech CEO Summit Europe (the “Summit”), and you will only be able register to participate in the Summit if Demy-Colton has provided you with a registration access code.  We, or our third party service provider on our behalf, will collect information from you if you elect to register for the Summit.  This information may include your first and last name, academic credentials, the name of your company, your title and position in the company, your telephone number, your email address, your fax number, your gender, your VAT number and a brief bio about you and your company.  In addition, we may collect information from you when you submit a request for more information about the Summit, for example, if you contact us by email we will collect your email address for purposes of responding to your request or inquiry.
    2. Information Automatically Collected Through the Site.

      We may automatically collect information about you when you use the Site. For example, if you access the Site through a computer, we will automatically collect information such as your browser type and version, computer and connection information, IP address and standard web log information. If you access the Site through a mobile device, we may also be able to identify the location of your mobile device. You may choose not to share your location details with us by adjusting your mobile device’s location services settings. For instructions on changing the relevant settings, please contact your service provider or device manufacturer.

      We may automatically collect information from you when you use the Site using “cookies” and other similar technologies, such as web beacons. Cookies are small amounts of data that are stored within your computer’s Internet browser and that are accessed and recorded by the websites that you visit so that they can recognize the same browser navigating online at a later time.

      Information that may be collected by cookies when you use the Site may include, without limitation:

    3. Information Collected by Third Parties through Third Party Links and Content. The Site may include links to other websites and other content from third party businesses. Demy-Colton does not have access to or control over these third parties or the cookies, web beacons or other technology that these third parties may use. We are not responsible for the privacy practices of these third parties or the content on any third party website. You are encouraged to review the privacy policies of the different websites you visit.
  2. How We Use the Information We Collect. We use the information we gather through the Site to contact and communicate with you, to respond to your communications, and to provide you with the information and services you have requested or signed up to receive, including sending you our newsletter by email and/or postal mail. We may also use the information we gather through the Site to analyze your use of the Site and to improve or personalize the services we provide to you.
  3. How We Share Your Information with Third Parties. Demy-Colton shares your information with third parties in some circumstances, as follows:
    1. Employees, Third-Party Processors and Third-Party Service Providers. We will disclose your information to our employees, contractors, affiliates, distributors, vendors, suppliers and other service providers (“Service Providers”) who provide certain services to us or on our behalf, such as operating and supporting the Site, analyzing data, or performing marketing or consulting services. These Service Providers will only have access to the information needed to perform these limited functions on our behalf.
    2. Response to Subpoenas or Court Orders or to Protect Rights and to Comply with Our Policies. To the extent permitted by law, we will disclose your information to government authorities or third parties if: (i) required to do so by law, or in response to a subpoena or court order; (ii) we believe in our sole discretion that disclosure is reasonably necessary to protect against fraud, to protect the property or other rights of us or other users, third parties or the public at large; or (iii) we believe that you have abused the Site by using it to attack other systems or to gain unauthorized access to any other system, to engage in spamming or otherwise to violate applicable laws. You should be aware that, following disclosure to any third party, your information may be accessible by others to the extent permitted or required by applicable law.
    3. Business Transfers; Bankruptcy. In the event of a merger, acquisition, bankruptcy or other sale of all or a portion of our assets, any user information owned or controlled by us may be one of the assets transferred to third parties. We reserve the right, as part of this type of transaction, to transfer or assign your information and other information we have collected from users of the Site to third parties. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred user information will be subject to this Privacy Notice. However, any information you submit or that is collected after this type of transfer may be subject to a new Privacy Notice adopted by the successor entity.
    4. Aggregate Information. We may share information relating to users of the Site with affiliated or unaffiliated third parties on an anonymous, aggregate basis. While this information will not identify you personally, in some instances these third parties may be able to combine this aggregate information with other data they have about you, or that they receive from third parties, in a manner that allows them to identify you personally.
  4. Children Under Age 13. The Site is not intended for children under age 13. We do not knowingly collect or distribute personal information from or about children under the age of 13.
  5. Security. We implement industry standard security measures intended to protect against the loss, misuse and alteration of the information under our control. Please be aware that no data transmission over the Internet can be guaranteed to be 100% secure. As a result, Demy-Colton cannot guarantee or warrant the security of any information you transmit on or through the Site and you do so at your own risk.
  6. Amendments to this Privacy Notice. We will notify you of material changes to this Privacy Notice by posting the amended terms on the Site at least ten (10) days before the effective date of the changes. If you do not agree with the proposed changes, you should discontinue your use of the Site prior to the time the new Privacy Notice takes effect. If you continue using the Site after the new Privacy Notice takes effect, you will be bound by the modified Privacy Notice.
  7. Accessing, Changing and Managing Your Information. You may make changes to the user information you have provided in connection with your account by logging in to your account and changing the applicable information. Following receipt of a request from you, we will take reasonable steps to update, correct or delete your information as requested.
  8. Special Information for individuals residing in the European Economic Area (“EEA”)

    If you reside in the EEA, your information will be processed by us in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) as explained below.

    1. Legal Basis for the Processing of Your Personal Information

      We process information about you on the basis of your consent provided by you by accepting the terms of this Privacy Notice when you log in to the Site or when you access or use the Site. In such case our processing or your information will be based on Article 6(1)(a) GDPR. You may withdraw your consent at any time which will however not affect the lawfulness of any processing activity performed on the basis of your consent prior to the withdrawal.
      If the processing of your information is necessary for the performance of a contract between you and us or for taking any pre-contractual steps upon your request, such processing will be based on Article 6(1)(b) GDPR. We may also process information about you when it is necessary for compliance with our legal obligations. In such case such processing will be based on Article 6(1)(c) GDPR. Furthermore, we may process your information when we have a legitimate interest to do so, in particular to ensure compliance with the terms that are applicable to your use of the Site or to assert or defend legal claims. In such case, the processing will be based on Article 6(1)(f) GDPR.

    2. European Union Data Subject Rights

      You may at any time access the user information you provided to us in connection with your member account by logging in to your member account. You may also ask us to provide you with information about any other personal data pertaining to you that is processed by us.
      You may make changes to the user information by logging in to your account and changing the applicable information. You may also request changes to your personal data by contacting us. You may request us to erase or stop processing your information. In some circumstances, we may however be required by law to retain your data even after an erasure request has been made. In these cases, we will not use your data except as needed to meet our legal obligations.
      We will take reasonable steps to fulfill your requests. You have the right to lodge a complaint with the relevant supervisory authority if, in your opinion, your right to the protection of your personal data has been infringed.

    3. Transfer of your data from the EU to the US

      Since our headquarters are located in the United States, any information we collect from you will be processed in the United States. The United States has not sought nor received a finding from the European Union that they ensure an adequate level of protection under Article 45 GDPR. Therefore by deciding to use the Site you must take into account potential risks connected with the transfer of your information to the United States and the fact that the adequate level of protection under GDPR is not assured. We collect and transfer to the United States your information only: with your explicit consent, to perform a contract with you, when it is necessary for the establishment, exercise or defense of legal claims and in a manner that does not outweigh your rights and freedoms. We care about the privacy and security of your information and apply suitable safeguards to protect the privacy and security of your information.
      We may transfer your data to entities outside of the EEA, in particular to third-party processors and third-party service providers. In such case we apply suitable safeguards to protect your information.

    4. Retention of Your Information

      Your personal information will be retained as long as you use the Site or as otherwise required by law or for the purpose for which we process your information.
